ICC: 70 States Groups To File Amicus Briefs Over Israel, Hamas Arrest Warrants Requests

The International Criminal Court (ICC) has granted 70 states, organizations, and individuals permission to submit amicus briefs concerning the decision by ICC Prosecutor Karim Khan to seek arrest warrants for Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant, and Hamas leaders for alleged crimes against humanity and war crimes.

According to Times of Israel, these briefs must be filed by August 6, but the high volume will delay the Pre-Trial Chamber I’s decision on the warrants.

Prof. Yuval Shany from Hebrew University’s Faculty of Law and Prof. Amichai Cohen from the Israel Democracy Institute have been permitted to submit an amicus brief. Shany notes that this decision is unusual at this stage and may reflect the court’s concerns about its jurisdiction and the case’s admissibility.

Several entities likely to support Israel’s stance have also been allowed to file briefs, including Germany, which has questioned the case’s admissibility, Argentina, US Senator Lindsey Graham, the Israel Bar Association, the International Association of Jewish Lawyers and Jurists, and a coalition of organizations such as UK Lawyers for Israel, B’nai B’rith UK, the International Legal Forum, the Jerusalem Initiative, and the Simon Wiesenthal Center.

Conversely, numerous parties opposed to Israel’s position have received permission to submit briefs, including South Africa, Ireland, Bangladesh, and Spain.
